These Terms and Conditions ("Terms") govern access to and use of the websites afmcsg.com and unicornboost.asia, and the purchase and use of digital reports, subscriptions, software-enabled services, and related offerings provided by AFMC Pte. Ltd. ("AFMC", "Company", "we", "us" or "our"). Singapore law recognises the formation and validity of contracts by electronic communications and records, which supports online contracting and acceptance of website terms in electronic form.
By accessing our websites, placing an order, checking a box indicating acceptance, or using any of our products or services, you agree to be bound by these Terms. If you are acting on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

AFMC develops and operates software platforms and produces market intelligence reports and related digital products for business customers. Products may include one-off reports, downloadable files, subscription-based access, software-enabled features, analyst-supported services, and related commercial offerings made available through our websites or affiliated product pages.
Unless expressly agreed otherwise in writing, all products and services are provided for business or professional use only.
An order submitted through our website is an offer to purchase the selected product or service. A binding contract is formed when we accept the order, including by confirming the order, making the product available for download or access, or otherwise beginning fulfilment. Singapore's Electronic Transactions Act recognises that offer and acceptance may be expressed electronically.
We reserve the right to reject, suspend, or cancel any order where there is a pricing error, payment issue, suspected fraud, legal or compliance concern, product availability issue, or breach of these Terms.
We aim to describe products, features, deliverables, pricing, and service levels as accurately as reasonably possible. However, website content, product descriptions, timelines, file formats, coverage scope, analyst participation, and platform features may be updated, corrected, modified, or withdrawn from time to time.
Any delivery timelines, report release dates, analyst involvement, or feature descriptions are estimates unless expressly stated to be binding.
For a standard purchase, we may request only the purchaser's name and email address. Where invoicing or business verification is required, we may also request company name, billing address, business registration information, VAT or tax information, country, or other information reasonably required to issue an invoice, fulfil the order, maintain records, or comply with legal obligations.
You agree to provide accurate, complete, and current information.
All prices are stated in the currency indicated on the website or order page. Unless expressly stated otherwise, prices do not include applicable taxes, duties, bank fees, currency conversion charges, or other similar charges that may apply.
Payments are processed by Stripe or another payment service provider identified at checkout. Stripe's or the relevant provider's own terms, privacy policies, and operational rules may also apply to the payment transaction. AFMC does not collect, access, or store payment card details on its own systems.
You are responsible for any taxes, withholding obligations, import or local charges, or other governmental fees applicable to your purchase, except for taxes imposed directly on AFMC's income.
Digital products are delivered electronically, including by email, download link, customer portal, product dashboard, or other online access method designated by AFMC. Delivery is deemed completed when the purchased report, file, licence, or access credentials are sent, made available, or activated.
You are responsible for ensuring that your email address, spam filtering, device, browser, internet connection, software environment, and access credentials allow receipt and use of the purchased product.
Because reports and digital products are delivered electronically and may be accessed immediately, all sales are final unless otherwise required by applicable law or expressly agreed by AFMC in writing. Refunds, credits, replacements, or re-performance may be considered at AFMC's discretion in cases such as duplicate payment, failed delivery caused solely by AFMC, or material mismatch between the purchased product and the confirmed order.

Unless expressly stated otherwise, AFMC grants the purchaser a limited, non-exclusive, non-transferable, revocable licence to access and use the purchased digital product for the purchaser's internal business purposes only.
Except where expressly permitted in writing, you may not:
Where a multi-user, enterprise, partner, or redistribution licence is required, separate written commercial terms must be agreed.
All intellectual property rights in the websites, reports, software, branding, databases, layouts, text, graphics, research methodologies, downloadable materials, and related content remain owned by AFMC or its licensors. Purchase of a report or subscription does not transfer ownership of any intellectual property rights except for the limited licence expressly granted under these Terms.
Reports and products may rely on public, commercial, third-party, estimated, modelled, or curated data sources. Unless expressly stated otherwise, products are provided for general business information purposes and do not constitute legal, tax, accounting, investment, financial, regulatory, compliance, or other professional advice.
You remain solely responsible for evaluating the suitability of any product, interpreting results, and making your own commercial, legal, financial, or operational decisions.
To the fullest extent permitted by law, the websites, products, reports, software-enabled services, and related content are provided on an "as is" and "as available" basis. AFMC does not warrant that any product will be uninterrupted, error-free, fully comprehensive, continuously available, compatible with every environment, or suitable for every specific use case.
To the fullest extent permitted by law, AFMC disclaims implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, accuracy, or availability, except to the extent such disclaimers cannot lawfully be excluded.
To the fullest extent permitted by law, AFMC shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss, including loss of profits, loss of revenue, loss of opportunity, loss of data, loss of goodwill, business interruption, procurement of substitute services, or wasted management time arising out of or related to the websites, products, or these Terms, even if advised of the possibility of such loss.
To the fullest extent permitted by law, AFMC's total aggregate liability arising out of or in connection with any order, product, service, or these Terms shall not exceed the amount actually paid by the customer to AFMC for the specific product or service giving rise to the claim in the 12 months preceding the event giving rise to liability.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
You must not misuse the websites or products. In particular, you must not:
AFMC may suspend access, block activity, investigate misuse, or take appropriate technical or legal action where misuse is suspected.
If access credentials, user accounts, licence keys, or portal access are provided, you are responsible for maintaining their confidentiality and for all activity under your account unless caused by AFMC's own breach. You must notify AFMC promptly of any unauthorised access or suspected compromise.
AFMC handles personal data in accordance with its Privacy Policy. Where personal data is collected, used, or disclosed in connection with orders, enquiries, support, or service operation, it will be handled in accordance with applicable law, including Singapore's Personal Data Protection Act 2012.
These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter, or their formation, are governed by and construed in accordance with the laws of Singapore.
The parties submit to the exclusive jurisdiction of the courts of Singapore to settle any dispute or claim arising out of or in connection with these Terms, subject to any right AFMC may have to bring proceedings in another competent jurisdiction to protect its rights or enforce a judgment.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. AFMC's failure to enforce any right or provision shall not constitute a waiver of that right or provision.
AFMC may update these Terms from time to time to reflect changes in its business, products, legal requirements, or operational practices. The updated version will be published on the relevant website with a revised "Last updated" date, and continued use of the websites or products after publication constitutes acceptance of the updated Terms.
